Before Your Trip

Scope of Services

FishingBooker only acts in the capacity of an intermediary on behalf of the Vendor or other Principal that provides its Services. By making a booking through FishingBooker, Customers enter into a contract directly with the Vendor and they will be subject to their terms and conditions. The delivery terms and conditions of a Vendor can be obtained from the relevant Vendor, if requested, prior to a booking being confirmed or along with the booking confirmation. By confirming their booking, Customers accept the Vendor’s terms and conditions as well as FishingBooker’s Terms and Conditions.

FishingBooker will not be liable for anything stated in the Vendor's terms and conditions. The FishingBooker Agreement with Customers sets out a Customer’s rights and obligations when they book or reserve fishing trips through us.

From the point at which a Customer makes a reservation, FishingBooker acts solely as an intermediary between the Customer and the Vendor, transmitting the details of a Customer's reservation to the relevant Vendor and sending them a confirmation email for and on behalf of the Vendor.

We will do our best to assist the Customer, but will have no liability and expressly disclaim any liability in relation to the performance of the contract with the Vendor. Any issues should, therefore, be taken up with the Vendor directly.

By making a reservation with a Vendor, Customers accept and agree to the relevant cancellation and no-show policy of that Vendor, and to any additional terms and conditions of the Vendor that may apply to the reservation, including for services rendered and/or products offered by the Vendor (the delivery terms and conditions of a Vendor can be obtained from the relevant Vendor). The general cancellation and no-show policy of each Vendor is made available on our website on the Vendor information pages during the reservation procedure and in the booking confirmation email. Please note that certain rates are not eligible for cancellation or change. Customers are instructed to check the Vendor's details thoroughly for any such conditions prior to making a reservation.

By making a reservation with a Vendor, Customers have to accept and agree to these Terms of Use as well as to the relevant Terms and Conditions of the booked Vendor, and, by doing so, are obliged to inform other members of their party of the applicable terms.

Requirement to Review Vendor Rules and Restrictions

Separate terms and conditions may apply to a Customer's reservation and purchase of travel-related goods and the services that they select. Customers are instructed to read these separate terms and conditions carefully on the Vendor's listing page. Customers should address all relevant questions with the relevant Vendor by using the FishingBooker Instant Messaging feature before booking a trip. Customers agree to abide by the terms and conditions of purchase imposed by any Vendor with whom they elect to deal, including, but not limited to, the payment of all amounts when due and compliance with the Vendor's rules and restrictions regarding availability and use of fares, products, or services. FishingBooker reserves the right to cancel a Customer's booking if full payment is not received in a timely fashion. Customers acknowledge that some third party Vendors offering certain services and/or activities may require Customers to sign a liability waiver prior to participating in the services and/or activity they offer. Customers understand that any violation of any Vendor's rules and restrictions may result in a cancellation of their reservation(s), in them being denied access to the applicable product or services, and/or in them forfeiting any monies paid for such a reservation.

Insurance and Safety

It is a condition of booking with FishingBooker that Customers and all members of their party, including infants and children, are adequately insured. Some hazardous activities may require additional coverage. Customers are instructed to check this with their insurance dealer. It may be a term of the Customer's contract with the Vendor that they take out suitable insurance cover and inform the Vendor of it so that they can take down your insurer's details. FishingBooker cannot accept responsibility for any costs Customers incur as a result of not being adequately insured.

In the event that a Customer or Vendor experiences any cost that may occur prior to, during, or after the trip, due to the cancellation of a trip, FishingBooker will not be responsible regardless of the reason for the cancellation.

By booking a trip, Customers acknowledge and accept that fishing, as an activity, bears inherent risks such as slipping on the boat, accidentally hitting a fellow angler with a rod, seasickness, etc, and FishingBooker is not liable for any such occurrences.

BY OFFERING SERVICES TO PARTICULAR INTERNATIONAL DESTINATIONS, FISHINGBOOKER DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND IS NOT LIABLE FOR DAMAGES OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS.

Documentation

Once Customers receive a confirmation email, they are instructed to check it carefully to make sure that all details are correct and also ensure that the names given are the same as in the relevant ID documents they may be asked to present to the Vendor. If Customers believe any detail to not be correct, they should contact FishingBooker. Customers are instructed to ensure that they check the information provided so that they are fully aware of timings, durations, departures, and other details. Customers are advised to read our Platform Rules and Guidelines prior to their trip. If Customers are unsure about any aspect of their trip, they should contact our Customer Service department.

Although every effort has been made to ensure that information displayed on the Platform is entirely complete and accurate, FishingBooker accepts no liability for any injury to persons or any loss or damage to property caused by errors or omissions in the data displayed, whether they result from negligence, accident, or any other cause. FishingBooker does not accept responsibility for any activity or procedure that may be necessary in order to enjoy the use of FishingBooker’s services, including, but not limited to, procuring or having in possession any passport or valid identification for travel or fishing licenses, and/or other documentation required by state law in the state/country in which the fishing trip takes place. This is the sole responsibility of the Customer.

Please note that laws and regulations related to fishing and licensing differ around the world, and it is the sole responsibility of the Customer to inform themselves of them. FishingBooker makes no representations about, confirms, nor endorses any Vendor or Customer, nor any Vendor or Customer's purported identity or background. Any references to a Vendor being "verified" (or similar language) only indicate that the Customer or Vendor has completed a relevant verification or identification process and nothing more. Any such description is not an endorsement, certification, or guarantee by FishingBooker about any Vendor, including about the Vendor's identity, background, or whether the Customer is trustworthy, safe, or suitable. Customers should always exercise due diligence and care when deciding whether to book a trip and when communicating and interacting with a Vendor, whether online or in person, especially when they travel outside of their country of residence.

By using the website, Users agree that any legal remedy or liability that they seek to obtain for actions or omissions of other Vendors, Customers, or other third parties will be limited to a claim against the particular Vendor or Customer or another third party who caused them harm. Users agree not to attempt to impose liability on or seek any legal remedy from FishingBooker with respect to such actions or omissions.

Best Price Guarantee

In the unlikely event that a Customer finds a lower rate than on FishingBooker.com on another website within 24 hours of booking with FishingBooker.com, FishingBooker will credit or refund the difference in price to the Customer.

Travel must be completed in accordance with the booked itinerary to be eligible to receive a refund or credits for the price difference.

Notifying FishingBooker of a Claim

A Customer must file a Best Price Guarantee application form within twenty-four (24) hours after making their FishingBooker.com booking in order to make a claim under the Best Price Guarantee. The lower rate must be available for booking at the time they contact FishingBooker, as determined by FishingBooker customer service representatives.

Must be "Apples to Apples" Comparison

The Best Price Guarantee is available only for exact itinerary matches – this means the same: specific vessel, trip type, duration, number of guests, and the exact same dates and times of travel or service as booked through FishingBooker.com. For any stand-alone product booking (for example, a single day trip), the comparison must be to the same product purchased stand-alone through another website (i.e. not part of an all-inclusive or multi day trip package). The Best Price Guarantee is not available for bookings on websites where the charter operator, itinerary, or similar booking details are unknown until after purchase. Customers must meet all requirements imposed on the lower price (if any), including, without limitation, residency, regional, and age-related requirements.

Comparison Rates must be available to the general public online. The Best Price Guarantee applies only to prices both advertised and available to the general public on an English-language website. For example, this does not include rates offered on:

  • Membership program websites, corporate discounts, or rates;
  • Group, rewards program, incentive, meeting, convention, consolidator, or interline prices;
  • Prices obtained via auction or similar process;
  • Prices available only by using a coupon or other promotion not offered to the general public.

The lower rate must not come from a website where you are required to call in order to get the rate or from an email that you received. In addition, the rate must be quoted, booked, and paid for in US dollars. In the event when a lower rate is expressed in a foreign currency, for the purpose of applying the Best Price Guarantee Policy, the rate will be converted to US dollars.

The rates must be compared in the total amount paid, not only in the amount presented in the offer, as we compare the total cost with/without taxes, with/without processing fees, etc.

Important note regarding additional services: To qualify for the Best Price Guarantee, you must have paid the required prepayment deposit on the booking in full.

Verification of Claims

All requests, including receipts, are subject to verification by FishingBooker. FishingBooker will not accept screenshots or other purported evidence of a lower price that cannot be independently confirmed by FishingBooker personnel, nor will FishingBooker verify any request that it believes, at its sole discretion, is the result of a printing or other error, or is made fraudulently or in bad faith. Verified requests will receive a credit to the credit card used for the booking, within approximately 7–10 days of verification.

Changes

FishingBooker reserves the right, at its sole discretion, to modify or discontinue the Best Price Guarantee or to restrict its availability to any person at any time, for any or no reason, and without prior notice or liability to Users. The terms that are in effect at the time of a User's booking will determine their eligibility under the Best Price Guarantee. No change in the Best Price Guarantee program will affect any credit that has already been issued. The failure of FishingBooker to enforce any provision of these Terms and Conditions will not constitute a waiver of that provision.

Canceling or Changing Your Booking

Cancellations

If a Customer needs to cancel their Trip, they can do so on their "My Bookings" option on the website or the FishingBooker Customer app, by clicking on "Cancel Booking". Customers must request the cancellation through the FishingBooker platform, otherwise it will not be deemed valid.

If a Customer cancels their trip before the Vendor's cancellation period, their cancellation will be processed automatically and they can receive a full refund of their deposit.

If a Customer's cancellation breaches the Vendor's cancellation policy, they will be charged the amount of their deposit. If a Customer books their trip through Online Payments and breaches the Vendor's cancellation policy, they will be charged the full amount of the trip.

If a Customer cancels due to extenuating circumstances, they may still be able to get their money back. Customers may review our Extenuating Circumstances Policy to check if they are eligible to receive a refund.

If the Vendor has to cancel a Customer's trip, FishingBooker will refund their deposit.

Please note that Vendors have the ultimate responsibility for the safety of the crew and everyone on board. In the event that the trip is no longer safe due to any reason, the Vendor has the right to cancel the whole or part of the trip (before or after departure). If a trip has been canceled prior to departure due to unsafe weather conditions (within 7 days of the trip date), Customers will be able to:

  • Accept from FishingBooker a full refund of the deposit paid for the canceled service(s). In the event that the booking was made through Online Payments, they will receive a full refund of the paid amount.
  • Accept from FishingBooker a substitute service(s) of equivalent value, where such a substitute is reasonably available.
  • Accept from FishingBooker a substitute service(s) of lower value if no service(s) of equivalent value is reasonably available, and to recover from FishingBooker the difference in the deposit between the deposit of the trip originally purchased and that of the substitute one.

FishingBooker is not responsible for any incidental expenses or consequential losses that you may have incurred as a result of the canceled booking such as visas, vaccinations, accommodation, non-refundable flight or rail tickets, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment, etc. FishingBooker reserves the right to issue a full refund in lieu of the choices above, at its sole discretion.

Please note that all cancellation requests must be sent within 15 days of the trip date. We cannot process cancellation requests sent more than 15 days after the trip date.

Changes

If a Customer needs to change any details about their trip, they can request to do so here. Please keep in mind that Customers must request the change through the FishingBooker platform, otherwise it will not be deemed valid. To propose a change to their booking, Customers should go to "Change Booking" on their booking details page. They can then enter the proposed changes and also contact their Vendor, who will be notified of their request and will, subsequently, have 48 hours to respond. If they do not respond, then the change request will not have been accepted and the original trip details will remain in place.

For Private Trips, Customers can request a change of the date and start time of their trip, the size of their group as well as package change if it’s available. For Shared Trips, Customers can request to change the date and the size of their group.

Changing a trip may incur additional charges. A change request can be withdrawn as long as the Vendor hasn't responded to it yet. If a Vendor does not accept a Customer's change request, the original trip details stay the same. If a Vendor requests to change a trip, Customers will be notified and can either accept the change or decline and suggest a different time/date without incurring a penalty.

FishingBooker reserves the right to change any booking, at its sole discretion, for any reason.

Unused Services

Neither FishingBooker nor its authorized representatives will offer or pay any discounts or refunds for missed or unused services which were missed or unused by the Customer due to no fault of FishingBooker or its representatives, which will include any termination of the Customer's participation in the Service due to the Customer's own fault, negligence, or breach of these Terms.

After The Trip

Complaints

As the Customer contract is with the Vendor, all complaints should be addressed to them. However, FishingBooker will do our best to assist Customers with any queries or concerns they may have relating to their arrangements. If Customers have a problem while on a fishing trip booked through FishingBooker, they must report to the Vendor, their local supplier, or representative immediately. If Customers fail to follow this procedure, their complaint is less likely to be properly investigated and rectified. Any complaint upon a Customer's return from their trip must be directed to the Vendor. Customers will see the Vendor’s contact details on the confirmation documents FishingBooker sends to them. FishingBooker will, of course, do its best to assist Customers if required.

In the event that any User requires the contact information of another User, FishingBooker reserves the right:

  • To provide the requested information with the consent of the User who owns the requested information;
  • To provide the requested information after the reception of an official request issued by the government and public authorities.

If you are a resident of the European Economic Area and you disagree with the way your complaint was handled, you may be able to complain via the European Commission's ODR (Online Dispute Resolution) platform (ec.europa.eu/odr), depending on the nature and subject of your complaint.
